Cedarhurst Gas Station Caught Price Gouging During Sandy

Station allegedly charged more than $5 for a gallon of regular gas.

New York State Attorney General Eric T. Schneiderman announced Thursday that his office has notified 13 gas station operators, including one from Cedarhurst, of his intent to commence enforcement proceedings against them for violations of the New York State Price Gouging statute.

Schneiderman said that the Shell gas station located at 408 Rockaway Turnpike in Cedarhurst was charging more than $5 for a gallon of regular gasoline.

Prices on the 13 gas stations ranged from $4.74 to more than $5.50 per gallon.

Of the 13 stations, the Cedarhurst location was the only one in Nassau County. Three other stations were located in Suffolk, while the remainder were in Westchester, Brooklyn, Queens and the Bronx.

These are the first of what Schneiderman said is "expected to be a series of actions taken in a wide-ranging investigation launched in the wake of Hurricane Sandy for price gouging after receiving hundreds of complaints from consumers across the state of New York."

"Our office has zero tolerance for price gouging and we are taking action to send a message that ripping off New Yorkers is against the law," Schneiderman said.

According to a release, New York State’s Price Gouging Law (General Business Law 396-r) prohibits merchants from taking unfair advantage of consumers by selling goods or services for an "unconscionably excessive price" during an "abnormal disruption of the market."

Under state law, Hurricane Sandy is classified as an "abnormal disruption of the market."

Schneiderman said that an "unconscionably excessive price" can be determined if there is a "gross disparity" between the price stemming from a consumer complaint and the price before the "abnormal disruption."

"These 13 retailers stand out from others in the high prices they have charged and in the size of their price increases," Schneiderman said.

I was waiting on line that saturday he opened up.he is a crook and he should be sent to jail. but the people in the five towns forget DO NOT BUY GAS HE IS A CROOK

This same station takes Stop N Shop points as discount. Sooooooo they mark up the gas so u pay the same as nextdoor Getty and Sunoco without using a discount!!!!! RIPOFF!!!! He was charging 4.659 for premium and i went nextdoor and paid 4.31!

I dont know why people are making such a stink about the price... You needed gas you went there you saw the price you got the gas MOVE ON! It is what it is ... These people are the most NICEST PEOPLE I ever met and they are NOT CROOKS!!

This is the same poor station that was one of the first to lose power, get flooded, & one of the last to get power back. Lighten up people & support our neighbor.

NICE PEOPLE DO NOT mark up gas to rip people off who THINK they are saving money. NICE PEOPLE DO NOT take advantage of people when they are desperate and their homes are destroyed and they need gas to warm them and run their fridges. WAKE UP!

The owners of this station would charge you for a life preserver on the Titanic.They committed thievery at the pinnacle of a disaster. Shell should disenfranchise the operators.

Does "Shell" really care? The large oil companies are the masters of overpricing in shortages and disasters.They make huge profits during /after disasters..larger than normal. That tells you a lot about their morality.

No 'V' I did not get gas there during storm or EVER. The price gouging mentioned was before the storm and I drove away and got gas at the next station. I am not the least bit surprised that he was gouging even further while people were desperate!

If enough people email shell they will care. The owners of this statiion are part of the community, they depend on regular customers to support their busness, is this a way to show their gratitude to the community? No other station in nassau raised prices.

If Shell was price gauging before the storm, then shame on them. If they did the same w/ o permission of Shell, they can lose their license to sell. I, for one, was happy to pay "only" five dollars after waiting only an hour before the morons in Albany decided to emulate NJ and institute odd/even days which eliminated lines completely. (Hear that jimmy "Ah have lust in Mah heart" carter. Hey, we are so much more righteous than our sinful neighbors in NJ that we allowed them to make tens of billions of dollars in gambling in AC before we opened up our money losing casinos. I think I will move to Iceland where we spent five days avoiding Sandy.

This was NOT the only station that did this in nassau county...Many on the same strip were price gauging as well...only this one was singled out. they are investigation ALL of them..

I dont know the exact story but I know that these people are community oriented and very involved. They tried to distribute gas to all they can and help with what they can do!!!!!!.

Commuunity oriented? TODAY he is charging 4.71 for premium! Next door at Sunoco 4.23 cash/4.33 charge. HIS gas is MORE premium????? Come on already!!! They are ripping people off EVERY DAY.
